and invoking the memory of her father. her fate could be in the hands of the jury as early as today. and supersized, the major food overhaul. today thursday, february 27, 2014. from nbc news, this is "today" with matt lauer and savannah guthrie live from studio 1 a in rockefeller plaza. welcome to "today," 7:00 a.m. on the west coast on a thursday. the big story out west, the rain, really the first significant rainfall they have had in months. >> al has called it a double edged sword. al is tracking really intensely cold weathert that is striking many parts of the country.

he is on a coast guard ice breaker in the frozen hudson river. he has been tracking the temperatures. good morning to you. >> i think we lost al. the trouble with having shots like that. >> cold weather reeks havoc on a lot of things. miguel almaguer is in california covering the storms there. >> reporter: it is certainly wet here, not as cold as where al is. rain, we are getting a lot of it here. let me give you statistics. over the last 24 hours or so we got about an inch of rain. over the last eight months here in california we have gotten about an inch. this is certainly a significant storm. you can see the sand bags because locals are preparing for what we could see this afternoon, that is mudslides.

this is area where a significant fire broke out a couple of months ago. they are concerned the ground has turned into a cement-like material meaning the water will rush down mountain sides and into homes. let me show you video of last night of heavy down pours from northern california all the way here to southern california. we saw damage across the state, down trees, localized flooding and high tide threatening beach communities. we saw delays at san francisco international airport. up to three hours, we can see more delays today because of the strong winds. that is the reason behind the knocked down trees. much of california hasn't had rain in so long. we are in an extreme drought here. our reservoirs are nearly completely dry. the water situation here is critical. to give you some perspective we need 15 inches of rain to return

to normal. this storm will only bring about one to four inches here in southern california. while that is certainly a significant amount of rain and while damage could come from that storm it is just a drop in the bucket when you consider our drought situation here. >> miguel almaguer, thank you. al roker putting the hand warmers on the equipment. hopefully we have it working now. al, take us through what is going on. >> reporter: thanks so much. again, this is brutally cold weather. let's take a look. we will show you our maps. first of all, as far as our temperatures are concerned, before we get to the maps i want to talk about the impacts of the heavy rain that they are getting now. in upstate new york we are

talking whiteout conditions on i-81. this morning 49 states across the country dealing with sub-freezing temperatures, hawaii the one exception. >> your fingers feel like they are going to break off. >> god is testing us. >> reporter: this satellite imagery shows the great lakes in september. now late february almost 75% frozen. lake superior almost completely covered in ice. speaking of ice, ice jams continue to clog rivers across the country. in ohio giant boulders of ice taking over parking lots. >> i'm totally sick of it. >> reporter: yes, this is just what we ordered, the sun. but please leave off the polar vortex. >> we will try to check back in with al in just a couple of minutes. the governor saying the bill threatened to divide her state

so she vetoed in. mike taibbi is live in phoenix. >> governor brewer actually had until saturday to make up her mind but after just one day of soliciting opinions on both sides of this controversial issue she has heard enough. when governor jan brewer returned to arizona after five days in washington the daily demonstrations against the so-called religious freedom bill were still going on. >> we will not stop with our opposition until this bill is vetoed. >> reporter: late wednesday afternoon brewer did just that. >> i have not heard one example in arizona where business owners' religious liberties have been violated. the bill is widely worded. >> reporter: warning of negative consequences, corporate and political voices kept piling on demanding a veto and warning of economic disaster if the bill

became law and after political stallworts decided to abandon it. >> we made a mistake and now we got to fix it. >> reporter: the governor made the predicted decision to the cheers of protesters gathered outside the state house. >> we were standing shaking with tears in our eyes. something finally -- our voices have tinily been heard. >> reporter: the bill still had some support. >> denying me as a christian my right to exercise my conscience. >> reporter: even a law professor who thought brewer sh have signed the bill and let the market place weed out bigots. >> if you have businesses that stand up in our society they are not going to last long if they are going to discriminate on the basis of same-sex marriage. >> reporter: the governor saw nothing but problems. >> i could divide arizona in ways we could not imagine and no one would ever want. >> reporter: now it is history. here is how certain even the protesters were that there would be a veto. before the press conference they

were distributing pre-printed high quality signs saying thank you governor, arizona is open for business for everyone. >> mike taibbi, thank you very much. nathalie has breaking news to talk to the volatile situation in ukraine. >> now we are hearing first words from the ousted president, viktor yanukovych. dozens of pro russian gun men seized control in the crimea region. richard engel is in kiev with the latest. good morning. >> reporter: well, we now think we know where he is. a russian source says viktor yanukovych has been granted asylum in russia after he appealed to russian authorities for his personal protection. he was asking for russian security. but meanwhile on the ground here in ukraine the situation continues to deteriorate mostly

in crimea. russian flags flying over the regional parliament in crimea put there after pro-russian gun men took control of the building overnight. they want this region part of ukraine near the russian border to join with russia. russia has military bases in crimea. the huge black sea fleet is based there. russia has said it will react uncompromisingly to defend its interest. russia put its air force on alert and began six days of war games near the border. 150,000 ground troops and heavy weapons. russian media described them as the biggest war games since the soviet era. the u.s. is watching closely and warning russia not to seize ukraine territory. or reimpose the ousted ukraine president. secretary kerry spoke with andrea mitchell. >> mr. putin should listen

carefully to ukraine who have voiced their desire for change. we are hoping that russia will not see this as sort of a continuation of the cold war. we don't see it that way. >> reporter: yanukovych now in exile in russia today claims he is still the legitimate president of this country. we are seeing the emergence of two rival governments, a parliament in kiev pro-europe and one in crimea that remains pro-russia. two years after the cruise ship hit a reef the captain of costa concordia returned to the wreck site today as part of his trial. ayman mohyeldin is covering the trial from london. >> reporter: for the first time since he left the trip as captain he is returning to the costa concordia as a defendant.

even locals are surprised the captain often called most hated man in italy would return. we have been a little bothered by that because we think he is somewhat guilty of all what happened said this resident. he is back along with inspectors surveying the ship that sits off the coast. it is part of the trial where he faces charges of manslaughter and abandoning ship after prosecutors allege the captain steered to close back in january of 2012. more than 4,000 passengers and crew were on board. 32 died as the cruise liner first hit a rock and began to capsize. during the trial prosecutors say he abandoned ship while passengers were scrambling to save their lives. if convicted he could face 20 years in jail. but he has defended his actions saying the rocks were not marked on the map, not detected by the ship's navigation system.

this cost more than a half a billion dollars to turn the capsized cruise up right, one of the most expensive salvage operations ever. former secretary of state hillary clinton is still keeping quiet when it comes to a possible run for the white house in 2016. clinton answered questions about arizona and the unrest in ukraine but the highlight came at the end of the night when a student asked whether she would change her to be determined status on her twitter bio. >> well, i would really like to, but i have no characters left. i will certainly ponder that. >> i guess we will have to keep on waiting. early polls show clinton leading jeb bush and marco rubio in home

of the second one is tainted by the first one. not as spectacular. >> want to cross your fingers. mr. al roker can you hear us? >> reporter: as you take a look live from chopper 4 you can see making its way. west coast here you go. winter storm titan comes on shore, heavy rain, makes its way inland bringing snow to the north, heavy thunderstorms down to the south and icy mix in between. even as we get into late sunday, early into monday it is going to make a mess. 100 million americans affected we asked people a question, how much money do you think you'll need when you retire? then we gave each person a ribbon to show how many years that amount might last. i was trying to, like, pull it a little further. [ woman ] got me to 70 years old. i'm going to have to rethink this thing. it's hard to imagine how much we'll need for a retirement that could last 30 years or more.

is like this long. >> reporter: but the labels themselves don't always tell the whole story. >> i try to look at the specific ingredients but mostly i'm looking at how many ingredients. >> reporter: now for the first time in 20 years, the fda is proposing big changes. here's the existing label and here's the proposed new label, including more accurate serving and calorie information. and they would have to include daily values for vitamin d. >> that is what's important. a lot of times i don't have time to look at all the nutrients on a label. >> reporter: advocates say the changes are long overdue. >> the kind of foods we're eating are causing a lot of illness and premature death among americans. the food label can help guide us toward healthier food. >> reporter: it's all part of

label? we hope you join the discuss on our facebook pages going on right now. >> one addiction expert says this drug will kill people as soon as it's released. dr. nancy snyderman is our medical editor. what is it about this particular drug that has so many health professionals concerned in. >> this drug packs a wallop. it has tn times more codeine than a typical vicodin. perhaps it the drug delivery system that needs help, not a bigger amount of the narcotic. this is a lot like oxycodone. and this pill in particular can be crushed, which raises the possibility of snorting it and ingesting it. since we've seen drug

in the fall of 2012, the advisory committee to the fda suggested not letting this drug go forward. and yet, right now, we're putting it on the market march 1st. >> a mixed message because the fda in the past has been pulling back on drugs like these and now releasing this one that is so potent. one emergency room physician said, "i'm talking about a drug somewhere in the neighborhood of 500 time more potent than what we're dealing with now. i'm five times more concerned about potency." >> the drug manufacturer says people don't start with these medications as gate way drugs. but that's not the issue. people with severe pain need good pain management. the question is how do we get the right medicine into the right hands. medication that can be crushed and so easily accessible i think today you have physicians across the board concerned. >> nancy snyderman. thanks as always.

and relieve your other allergy symptoms... so you can breathe easier all day. zyrtec-d®. good morning. i'm laura garcia-cannon. the breaking news in the south bay. a tanking crash shut 101. christie smith live in morgan hill where it will be some time before they reopen the lanes. >> reporter: good morning to you. i do have new information for you. i spoke with the chp. they tell me possibly 20 minutes until the number 1 lane or the far left lane can reopen. but the next step they say is getting this tanker truck that has rolled over on its side, you can see the front of it, getting that pulled out of the mud and out of here so they can clear the scene. the gasoline that was on it has been offloaded and put on another truck. chp says what happened is that a driver in a car lost control

overnight on southbound 101, past tenant and morgan hill, traveling at a high rate of speed and hit the tanker. it rolled off the road into a ditch, spilling about 4,000 gallons of gasoline. it was carrying about 8,000 gallons. the truck driver was basically okay but complained of pain and went to the hospital. for the other lanes that could be a couple of hours. christie smith, "today in the bay." >> i want to check with mike. the good thing this is southbound. >> we say good thing because it's counter commute f. you travel southbound that's a problem. looking over to the maps, this is the flowing in general as the commute starts to build. watch the roadways still a concern. up the peninsula a smooth drive. i had my map set to morgan hill. there we go. southbound slowing from approaching dunn and because of the closure at tenant the northbound side a distraction with all of this activity. christie says she thinks maybe 20 minutes to a half hour until they have one lane open. use monterey road.

back now at 7:30 on a thursday morning, the 27th day of february, 2014. pretty shot of sunrise over the frozen hudson river here in new york. down on that ice breaker, the coast guard ice breaker is our very own al roker admiring the sunrise and other things and giving us a very chilly forecast. we will have more on that in a few minutes. arizona's governor jan brewer has vetoed a controversial bill that would have allowed business owners to deny service to gays.

>> things like this are so important for kids. >> absolutely. >> that's the first lady doing a little yoga tomorrow only on "today." we begin with closing arguments today at care ey kennedy's drunk driving trial. katy tur has been following the case for us. >> inside the packed courtroom she answered every question she was asked. the key would be did she know she was under the influence of sleep medication when she allegedly side swiped a tractor-trailer? the kennedy's at court. their mother pushed to and from proceedings in a wheelchair. she is charged with misdemeanor

driving under the influence. police say in july 2012 she side swiped a trailer. on wednesday kennedy told her side of the story. that morning she said she thought she had taken her thyroid medication. she says i know now i must have taken the sleeping medication before. i really just don't remember. i remember getting on to the exit ramp and on to 684 and have no memory after that. kennedy's lawyers argue the thyroid pills were the same size as the generic and testified she only knowingly used the sleeping pills when she travelled. >> i thought it was perfect. >> prosecutors argue that even if she had taken the sleeping medication by mistake she had taken it in the past and should have gotten off the road once she felt its effects.

kennedy testified if i realized i was impaired i would have pulled over. >> she has to have intentionally taken that medication and driven under the influence of drugs. those are the charges against her. if it was simply a mistake, even a careless mistake she is not criminally responsible. >> reporter: kennedy talked about her organic garden and healthy lifestyle and asked about her family upbringing. she testified she was raised near washington because daddy was the attorney general. my mother raised us because my father died when i was 8. he was killed when he was running for president. a jury of six men and two women will decide kennedy's fate. prosecutors plan to call one more witness, an expert in sleep medications before closing arguments. then it will go to the jury. if convicted kennedy can face a year in jail, a fine and a southbou suspended license. >> proving intent is going to be

have been coming since the hudson river iced up like this. look what we have going on as far as temperatures are concerned over the next five days. there is no relief in sight. we have a subtropical jet and polar jet. look friday, saturday, sunday more reinforcing cold air coming in across the great lakes into the northeast. the warmer air is back down in central and southern florida and southwest. today big storm system, winter storm titan coming on shore into the california area. rain down in florida. we will take a look at that in a little bit and we have windy conditions in the pacific nort 7:36. good thursday morning to you. we still have light showers, mostly along the east shore. i want to show you the three dimensional view. you can see a lot of the shower activity is over the mountains, we're getting that orographic

good morning everyone. 7:56. i'm scott mcgrew. investigators combing through what's left of a townhouse complex after a fire in san jose. the flames forced several families including eight children out of their homes. the fire broke out just before 12:30 this morning on a complex at chenoweth avenue not far from oak grove high school. one town home is destroyed, others badly damaged. no word on a cause. a problem with an air conditioner caused the cabin of a delta plane to fill with smoke as it landed at the oakland airport. this is very dark video but it's a video of everyone just trying to get off of the plane, flying from l.a. to oakland. oakland firefighters did meet it on the runway. everybody made it off okay. let's check in with mike. big traffic day. >> it is. first of all, the big issue, let's show you video we took with our chopper over 101 in

morgan hill. this was a full closure for southbound side. the update, because we heard that we might have one lane open. what's going on here, you're looking at the red rig, offloading fuel. 4,000 gallons. now these all had lanes closed by the equipment and the fuel spill. we're looking at a smoother drive northbound but slow and we're looking for the update. so far chp has not let us know about lanes open. there is the slow drive down to morgan hill and san martin. the northbound side slow because of the additional distraction, slower, the rest of the south bay looks like the northbound routes are slow but steady. we're looking also to the peninsula, a smooth flow. over here north 280 there is a crash involving a car on its roof. watch for slowing north of 380.

slightly distorts things. so we made slight changes to the color of your roots. we tidied up some wrinkling on your suit, the tail of your jacket at one point. i think we removed one of our hands. the big change we made was opening one of al's eyes because we -- the photo was perfect except that he had one eye slightly closed because when you have four people together, it's difficult to capture everybody, you know, perfect moment. >> you're familiar with the controversy. some people think that magazines such as yours, all these photo shop so much that it sets up an unrealistic expectation and makes people feel bad about themselves. what do you think about that? >> it's a criticism i'm aware of. at cosmo, we never do anything to change somebody's body size. that's one of the crucial red lines. what we will do is we will do

something to distort it, we might -- if someone comes in with a cold sore or a zit, we might remove us and they may beg us to do that. and sometimes when you're shooting for the cover, the celebrity is very stressed by it. i have to say, you guy were so brilliant in front of the camera, you're familiar with it, you live it. but most people are not that comfortable in front of the camera, even very well known actresses and they get very stressed about doing a photo shoot. they might get cold feet. so we would take those out. we once had a celebrity who had been doing some cutting and was very anxious that her scars didn't show. >> natalie has a question. you're seeing all the changes that were made. >> the extreme photo shopping. so at cosmo, you all are very careful about where you draw the line. other magazines, though, there's been some controversy. for example, the lena dunham picture in vogue, the cover, she actually loves her photos.

february is of course black history month. in washington a new smithsonian museum is under construction dedicated to the history of african-americans. kristen walker got a tour of the site. >> reporter: the national mall, once inhabited by slaves and slave owners is now being transformed into a permanent home for african-american history. >> our goal is that you'll come through this museum and you'll be changed. >> the smithsonian's national african-american history museum will take its place among the other national treasures here. >> this is the largest exhibit space. >> reporter: but director lonnie bunch says this space will be different. >> the reality is that the story of the african-american experience not as a story simply for african-americans but as a story that profoundly shapes our identity as americans needs to be told. >> reporter: bunch is a veteran in his field but unlike past projects, he and his team are building this museum from the ground up. 30,000 artifacts?
